1. Agreement to Terms

By downloading, installing, or using the SommelAI application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legal agreement between you and SommelAI Ltd ("we", "us", "our"), a company registered in England and Wales.

2. The Service

SommelAI is an AI-powered wine tasting companion that provides:

• Wine identification from label photographs
• AI-generated tasting scripts with text-to-speech narration
• Interactive Q&A with an AI sommelier character ("Sidney")
• Voice-activated questions via "Hey Sidney" wake word
• Wine rating and tasting note management
• Personalised taste profile generation and wine recommendations
• Digital wine cellar management
• Wine flight suggestions based on occasion and preferences
• Food and cheese board pairing recommendations
• Flight sharing via QR code

3. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are at least 18 years of age. SommelAI relates to alcoholic beverages and is not intended for use by minors.

4. Service Authentication

You do not need to provide any credentials, account details, or API keys to use the App. Authentication is handled automatically by the App on your behalf.

We may rate-limit usage per device to manage costs and prevent abuse. Reasonable everyday use is well within these limits.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Submit profane, abusive, or inappropriate content through the Q&A features
• Attempt to reverse-engineer, decompile, or extract source code from the App
• Use the App to generate content that infringes on intellectual property rights
• Misrepresent the AI-generated content as professional sommelier advice for commercial purposes
• Share QR codes containing misleading or false wine information

6. AI-Generated Content Disclaimer

Important: SommelAI uses artificial intelligence to generate wine identification, tasting notes, recommendations, food pairings, and shopping suggestions. This content is generated by AI and may contain inaccuracies.

• Wine identification: AI identification from label photos may be incorrect. Always verify wine details independently before making purchasing decisions.
• Tasting guidance: AI-generated tasting scripts are for entertainment and educational purposes. They do not constitute professional sommelier advice.
• Food pairings: AI-generated food and cheese board suggestions are recommendations only. They do not account for allergies, dietary restrictions, or intolerances unless explicitly specified by the user. Always check ingredients for allergens.
• Wine suggestions and shopping lists: Wine suggestions and shopping lists are AI-generated recommendations. We do not guarantee that suggested wines are in stock, available at the stated price, or currently sold by any particular retailer. Prices are estimates only.
• Health information: SommelAI does not provide health advice. Please drink responsibly. If you have concerns about alcohol consumption, contact your GP or visit drinkaware.co.uk.

7. Intellectual Property

The App, including its design, code, features, and content (excluding user-generated content and AI-generated output), is the intellectual property of SommelAI Ltd and is protected by copyright and other intellectual property laws.

You retain ownership of your tasting notes, ratings, and any personal content you create within the App. By using the App, you grant us a limited licence to process this content as necessary to provide the service (e.g., sending your rated wines to OpenAI for taste profile generation).

8. Third-Party Services

The App integrates with third-party services:

• AI providers: AI features are powered by third-party AI services. Use of these features is subject to the relevant providers' terms, which we apply on your behalf as part of delivering the App.
• Cloud sync (where supported): On iOS, data sync is provided by Apple iCloud. Your use is subject to Apple's iCloud Terms. On Android, no cloud sync is currently performed; data remains on the device.
• App distribution: The App is distributed via Apple's App Store (iOS) and Google Play (Android). Your installation and any in-app purchases are also subject to the relevant store's terms.
• Retailer references: Any references to wine retailers are for informational purposes only. We are not affiliated with, endorsed by, or partnered with any retailers unless explicitly stated.

We are not responsible for the availability, accuracy, or performance of third-party services.

9. Flight Sharing

When you share a flight via QR code:

• The QR code contains wine details (names, producers, regions, vintages) only - no personal data is included.
• Anyone who scans the QR code can create a copy of the flight on their device.
• You are responsible for who you share QR codes with.
• Shared flights are independent - changes made by one person do not affect another person's copy.

10. Limitation of Liability

To the maximum extent permitted by law:

• The App is provided "as is" and "as available" without warranties of any kind, whether express or implied.
• We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
• We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
• We are not liable for any losses arising from reliance on AI-generated content, including incorrect wine identification, unsuitable food pairing recommendations, or inaccurate pricing information.
• We are not liable for any charges incurred on your OpenAI account.
• Our total liability to you for any claims arising from or relating to the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

11. Indemnification

You agree to indemnify and hold harmless SommelAI Ltd, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App or violation of these Terms.

12. Termination

You may stop using the App at any time by deleting it from your device. We may suspend or terminate your access to the App at any time, with or without cause, with or without notice.

Upon termination, your local data will be deleted with the App. Any cloud-synced data (currently iCloud on iOS) can be managed through your platform's cloud-storage settings.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the App or via email. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SommelAI Ltd regarding your use of the App.
